WHY DID I GET A NOTICE?

A settlement has been reached in a class action arbitration between RRH-Florida, LLC d/b/a Denny’s (“Respondent”) and individuals who worked for Respondent as Servers in the Margate (“9590”), Plantation (“9592”), and/or Boca Raton (“9594”) Denny’s locations from July 18, 2019, through December 31, 2023. The arbitration alleges that Respondent violated the Fair Labor Standards Act (“FLSA”) and the Florida Minimum Wage Act (“FMWA”) by attempting to take a tip credit without providing sufficient notice of the federal and/or state tip credit, violating the 80/20 rule by requiring side work in excess of 30 continuous minutes, operating an unlawful tip surrender policy, and for failing to pay proper overtime wages. The case is Huffman, et. al. v. RRH-Florida, LLC d/b/a Denny’s, AAA Case No. 01-23-0003-7514, currently pending in the American Arbitration Association in South Florida. The proposed Settlement is not an admission of wrongdoing by Respondent, and Respondent denies that they violated the law. The Arbitrator has not decided who is right or wrong. Rather, to avoid the time, expense, and inherent uncertainty of litigation, the Parties have agreed to settle the lawsuit. Nothing herein shall indicate that the Respondent failed to pay you properly under the law or otherwise. The Settlement has been preliminarily approved by the Arbitrator appointed to the case.

You are included in the Settlement if you worked as a Server for RRH-Florida, LLC d/b/a Denny’s in the Margate (“9590”), Plantation (“9592”), and/or Boca Raton (“9594”) locations from July 18, 2019, through December 31, 2023.

If the Arbitrator approves the Settlement, members of the Class who submit valid claim form will receive a distribution from a settlement fund that Respondent has agreed to establish. Each individual who submits a valid claim will receive a portion of this fund, after all notice and administration costs, the individual consideration, and attorneys’ fees – if approved by the Arbitrator – have been paid. Payments for regular wages are estimated to be approximately $0.8952 for every hour worked by a Server. Payments for overtime wages are estimated to be approximately $2.5767 for every overtime hour worked by a Server.

Exclude Yourself

You can elect to get out of the Class and keep your right to sue RRH-Florida, LLC, on your own in regard to the claims in the lawsuit. To exclude yourself from participating in the Settlement, you must complete and return a request for exclusion.

The Notice of Appearance must be postmarked on or before July 15, 2024, to appear at the final hearing on July 22, 2024, at 10:00 a.m. which will be conducted through Zoom teleconference.

Do Nothing

You will be bound by the terms of the Settlement and give up your right to sue RRH-Florida, LLC, on these claims and any state wage and hour claim and receive no money.

Claim Your Settlement

If you wish to be included in the class Settlement, you may receive a cash payment if you submit an approved Claim Form as instructed.

Further, by submitting an Approved Claim Form you are also opting into the federal claims alleged in the lawsuit as noted on the Claim Form.
